Sample Llama Breeding and Sale Contracts

These contracts are only meant to aid other farms or businesses in the designing of their personal contracts for business. Each contract offers different scenerios and options so read through them all before creating your own. Please keep in mind, when conducting any sort of business transaction you should outline these details in writing prior to moving forward with any arrangements. Some of the most well meaning individuals have had some very ugly situations that could have been taken care of easily had there been some sort of contract in place.


Sample Breeding Contract:

Terms and Conditions-for Breeding to John Deere Green:

1. The owner will provide a copy of female's breeding contract prior to breeding service.
2. The owner will provide information showing:

a. Current Inoculation (Within I Year)
b. Current on Worming
We request that you have your animal dusted for lice (2 weeks) prior to arrival.
3. (Farm Name Here) will breed the female until she refuses the male for 21-28 days beyond her last breeding date.
4. Progesterone & ultrasound tests are available at the OWNERS expense.
5. A live birth is guaranteed if the female is reproductively sound as acknowledged by a llama veterinarian.

(Remember to be fair and if there is a situation where you feel you should go ahead and give a re-breed, do it for good business.)

6. The Breeder accepts no liability for a non-live birth, death of the offspring immediately after birth, birth defects or other abnormalities in the sired offspring. If the female aborts, births a stillborn cria or the cria does notsurvive after 72 hours, a free re-breed will be offered
(with an expiration of one year for its use).
7. Other re-breeds will be considered on a case by case basis.
8. (Name of Animal) breeding fee is $____.___ $____.___due as a deposit and the balance is due when the female is picked up from (Your Farm Name Here). Registration paperwork for offspring sired will not be turned over until all balances are paid in full.
9. A boarding fee of (Amount) per day will be charged after (Number) days (most farms do 30), unless otherwise negotiated.
10. The owner gives the Breeder and the Breeders Veterinarian permission to provide any emergency medical treatment for the female and/or cria should it be required. The cost of medical service will be that of the registered owner of the animal/s.
11. Signatures of Both Parties Involved!

Other Things You May Want To Include With Your Agreements:

1. Your policies
2. Training charges
3. Your breeding procedures
4. Complimentary services (worming, toenail trimmings, ect.....)
5. Medical charges
6. Delivery charges
7. Maiden exams by the vet.
8. Language that the line of the dam is free of any birth or other defects and that currently she is free from illness.
9. Also ask for disclosure of any problems with getting pregnant or pregnancy problems such as abortions or infections that the dam may have had
.


Sample Female Contract:

Terms and Conditions-for Purchase of breeding female Annie Deere
ILR# 12389:

Annie Deere is sold by Windy Acre Llama farm for the price of $____.___ to Joe Smith. She is sold for $2000.00 as a breeding female. The buyer has paid $500.00 as a downpayment by check #2345.
Annie Deere is guaranteed to be disease and parasite free. She is also guaranteed to be reproductively sound (able to produce healthy offspring) (as is evidenced by her current ultrasound and/or cria at side) Annie's background is that of healthy birthing and milking females. As part of this agreement, her current health and vaccination record ,will be provided to Mr. Smith upon taking possession of Annie Deere. Annie Deere's papers will be rendered upon delivery by Windy Acres to Mr. Smith and his final payment of $1,500.00. Annie Deere is purchased as a breeding female and should she by unable to conceive or carry a full term, healthy llama cria (as evidenced by a llama veterinarian), an animal of comparable value will be traded for her.

Along with the sale of Annie Deere we are providing a new halter and lead. Additionally, we have joined (Any Llama Organization) in your name and paid for your first year. You will receive your membership information and first issue of their newsletter soon. We recommend (name of place) for purchasing llama food and equipment. Should you ever have questions or need more information please feel free to call us anytime.

4. Any services or goods you know will be helpful to this new owner.
5. Do you want to charge for board or services that will be done to this animal before she ends up leaving your farm?
6. What are your farm guarantees or policies?
7. Do you want to include a discount or free breeding to your male? (make an expiration date on this offer)
8. Do you want to only guarantee this animal as is?
9. Do you want to make it clear that you are not responsible for sterilization due to infections or problems that occur because of the buyers care?
10. Do you want to stipulate what will show fertility with a maiden, thus relieving you of future liability?
11. Do you want to offer an upgrade animal policy?
12. Are you including show records or pack trial certificates? Other?


Sample Male Contract:

Terms and Conditions-for Purchase of breeding male John Deere
ILR# 12389:

John Deere ILR#12389 is sold by Windy Acre Llama farm for the price of $____.___ to Joe Smith. He is sold for $2,500.00 as a breeding male. The buyer has paid $2,500.00 in full by check #2345.

John Deere is guaranteed to be disease and parasite free. He is also
guaranteed to be reproductively sound (able to produce healthy offspring) (as is evidenced by his first settling of a female). Windy Acres Llama Farm is retaining the right to three breedings to John Deere. These breedings are non-transferrable and only valid until June 1, 2002 (date here). John Deere's background is that of healthy birthing and breeding animals. As part of this agreement, his current health and vaccination record will be provided to Mr. Smith upon taking possession of John Deere. John Deere's papers will be rendered upon delivery by Windy Acres. John Deere is purchased as a (breeding male) and should he by unable to settle or produce healthy offspring (as evidenced by a llama veterinarian), an animal of comparable value will be exchanged for him.

Along with the sale of John Deere we are providing a new halter and lead. Additionally, we have joined (Name of Organization Joined) in your name and paid for your first year. Sample Gelding & Non-Breeder Female Contract:

Terms and Conditions-for Purchase of gelding male or non-breeding female John or Annie Deere
ILR# 12389:

John/Annie Deere ILR#12389 is sold by Windy Acre Llama farm for the price of $____.___ to Joe Smith. He/she is sold for $500.00 as a gelding or non-breeding female. The buyer has made a down payment of $200.00 by check #2345 and will make payments of $50.00 per month. Payments will be completed by April 10, 1999. All payments are to be received by the 1Oth of the new billing month and any late payments will be charged an additional $1.00 per day they are late.

John/Annie Deere is guaranteed to be disease and parasite free. As part of this agreement, his/her current health and vaccination record will be provided to Mr. Smith upon taking possession of John/Annie Deere. (Pick One Of These Phrases) John Deere's papers will be rendered once Windy Acres receives proof of gelding or Windy Acres is holding the papers on Annie Deere as she is a non-breeding animal. Should Joe Smith ever breed Annie, Windy Acres has the right to take immediate custody of Annie Deere as this would be a direct violation of this agreement. Annie is sold as a non-breeding female (non-breeder defined as should never be bred for offspring). Should Joe Smith decide he wants to keep John Deere as an intact male, his papers can be purchased for an additional $2,000. 00 (Make the amount high so they won't breed the animal). John/Annie Deere has been trained as a (packer, 4-H animal, pet, fiber animal, cart llama ect.. ) and should he/she not meet the criteria of these standards an animal of comparable value will be exchanged for him/her.

Sample Partnership Contract:
Thank you to Kathie Sprout for This Sample

On this date ____________________________XXX and XXX enter into an agreement regarding joint ownership of (Llama's Name) female/Male llama, DOB XXXXXX, ILR I.D. XXXXX.

Each partner agrees to pay the sum of $XXXX to XXXXX no later than DATE. New registration papers will be submitted to ILR designating joint ownership of (Llama's Name). Transfer fee will be shared equally by both partners.

XXXX will be the primary residence of (Llama's Name), unless otherwise agreed to. The custodial partner is responsible for daily care, observation and record keeping. Non-custodial partner will pay $_____________ monthly to cover feed.

If (Llama's Name) becomes ill or injured, the custodial partner shall call the vet and notify the other partner. The non-custodial partner will hold the other partner harmless if this procedure is followed. Emergency vetting costs will be shared equally unless caused by the negligence of either partner.

Routine vet care such as annual CDT vaccinations, worming, nail clipping and shearing will be done and shared by the partners.

Breeding decisions will be made jointly. It is agreed that if she (if a female) is to be bred, the stud used will be rotated among the partners, each using their own choice stud every other year. Normal stud fees will be waived if the cria is co-owned.

Her progeny will be jointly owned till weaned, and then the partners must come to a mutual agreement as to the disposition of said progeny. This could include but is not limited to:

A. The offspring will be sold and the sale price divided equally.

B. One partner can buy the offspring for at the market value. The offspring then becomes the sole property of the buying partner.

C. A female offspring may be kept by one partner (if mutually agreed upon) in return for their share of (Llama's Name), thereby dissolving the partnership.

Decisions pertaining to disposition of offspring must be made prior to their 1st birthday deadline for registration. Partners always get first right of refusal on offspring.

Off farm activities such as showing, parades, off farm training, hikes, shall be discussed and agreed to prior to any event. The non-custodial partner is free to inspect (Llama's Name) and her/his living arrangements at any time. Miscellaneous, non-emergency expenses must be agreed on prior to each occurrence if either partner wants reimbursement for half. (Llama's Name)'s fiber will be shared by the partners.

Dissolving Partnership. Partners agree to review partnership agreement yearly on the anniversary of this agreement. Should either partner wish to dissolve the agreement, the other partner has primary rights to buy out their share for $XXXX. If the other partner does not want to buy, they have 90 days to find a new partner. If no buyer is found the selling partner is free to pursue selling their share to a buyer who agrees to the above stipulations. Either partner may ask for a review at any time.
